TERMS & CONDITIONS

Active8-290As in accordance with the following terms and conditions, the client and trainer will mutually agree Personal Training sessions, at a single specified time, in advance. Active 8 will be responsible for providing all equipment deemed necessary for the session.

TERM

The client hereby hires and retains the services of an Active 8 Personal Trainer for a booking of 5 sessions or more.

FEES

The fees for the booking shall be paid in full commencement of this agreement or at the beginning of the first session (please note these prices have not changed since we opened in March 03).

CANCELLATIONS

Cancellations must be made at least 24 hours in advance of scheduled sessions. Sessions cancelled less than 24 hours in advance will be charged in full to the client. The cancellation policy will be adhered to in all cases when the client is unable to attend. In some special cases this policy may be reviewed.

LATE ARRIVALS

Each session shall be 1 hour in duration. Sessions will not be extended (unless time is available) due to the lateness of the client or due to interruptions caused by the client. Any client who has not arrived within 20 minutes after the scheduled time shall be deemed to have cancelled and will be charged for the entire session.

Should the Personal Trainer arrive more than 15 minutes late for the session, it shall be deemed that the session will not be charged to the client. If the Personal Trainer fails to make a session with less than 24 hours notice the client will receive a free training session.

TRANSFERABILITY

This agreement shall be binding only between an Active 8 Health & Fitness trainer and the client. The client may not sell, assign or transfer their rights to Active 8 Health & Fitness Ltds services to any other party without permission from an Active 8 Health & Fitness trainer.

REFUNDS

All sessions paid for within the booking shall be completed within a period of 5 weeks (if the client has booked 5 sessions). Sessions can be used at a faster rate than 1 per week if the client insists. If a holiday, medical problem or other prolonged circumstances prevent completion of the contracted sessions within the time period set, the client may take an extended period of time. This will be agreed by Active 8 Health & Fitness Ltd. In all other circumstances the client will forfeit the remaining sessions. There will be no cash refunds.

PHYSICAL CONDITION OF CLIENT

Active 8 Health & Fitness Ltd Personal Trainers are fully qualified and attend rigorous training sessions on a regular basis but otherwise have no further general or specific medical knowledge, experience or qualifications and makes no representation or warranty to this effect. Before commencement of any Fitness programme, Active 8 Health & Fitness Ltd will conduct a comprehensive Fitness Assessment. This will be based on information gained from the client. All information given by the client must be true and honest at the current time.

Active 8 Health & Fitness Ltd excludes all liability for death, injury or damage caused by the client carrying out exercises incorrectly, contrary to the instructions or advises of Active 8 Health & Fitness Ltd or carried out without supervision of Active 8 Health & Fitness Ltd.

DISCLAIMER OF GUARANTEE

Nothing in this agreement and nothing in Active 8 Health & Fitness Ltd statements to the client shall be interpreted or construed as a promise or guarantee about the progress or results of a client’s fitness programme.

ENTIRE AGREEMENT

It is understood by both parties that this agreement is legally binding.

CLIENT CONFIDENTIALITY

All information obtained by Active 8 Health & Fitness Ltd will be treated in the strictest of confidence and in accordance with the Data Protection Act 1989.
